Ethics council reprimands Justice Anwar Usman for ethical violation

The Ethics Council of the Constitutional Court Honors (MKMK) has reprimanded Justice Anwar Usman after being found guilty of violating the Code of Ethics and Conduct for Constitutional Judges.

 “The reported judge was proven to have violated the Code of Ethics and Behavior of Constitutional Judges as stated in the principles of Appropriateness and Decency, points one and two of Sapta Karsa Hutama,” MKMK Chairman I Dewa Gede Palguna said on March 28, 2024.

This decision relates to his statement regarding dismissal from office, resulting in a second written reprimand for Anwar after previously being removed from the position of Chief Justice of the Constitutional Court.

Gede Palguna revealed that Anwar was proven to have violated the principles of Propriety and Decorum in his conduct.

This violation pertains to Anwar’s failure to adhere to impartiality requirements in the ruling on the eligibility of vice presidential candidates, particularly in granting special treatment to Gibran Rakabuming Raka, the running mate for presidential candidate Prabowo Subianto.

Anwar was reported to MKMK by lawyers Zico Leonardo Simanjuntak, Alvon Pratama Sitorus, and Junaidi Malau for his statements in a press conference highlighting the ethical sanction he received.

 “In the press conference, the reported Judge openly conveyed to the public which was covered by various media, especially regarding his objections regarding procedural procedures, the considerations of the Panel of Judges, and sanctions,” Yuliandri, MKMK member, said.

Additionally, Anwar also filed a lawsuit with the State Administrative Court (PTUN) regarding the appointment of the new Chief Justice of the Constitutional Court.

Yuliandri emphasized that Anwar’s actions, both in the press conference and in filing a lawsuit with PTUN, directly or indirectly affected the dignity and honor of the Constitutional Court. These actions are considered a violation of the principles of the Code of Ethics and Conduct for Constitutional Judges.

In response, MKMK decided to issue a written reply to Anwar Usman to reaffirm the importance of compliance with MKMK decisions.

The MKMK decision No. 2/MKMK/L/2023 underscores the importance of upholding the integrity and dignity of the institution.

“Therefore, the Ethics Council considers it necessary to give a written warning to the reported Judge to show its sincere compliance with the Ethics Council’s decision, in the case  Decision No.2/MKMK/L/2023,” Yuliandri said.
