AGO considers harsher sentences in Rp193.7 trillion Pertamina corruption case

Attorney General ST Burhanuddin has hinted at the possibility of charging suspects in the mismanagement of crude oil and refinery products at State energy company PT Pertamina, its subholdings and contractors (KKKS) in the period of 2018-2023.

 

Burhanuddin said that if there are aggravating factors, especially in the Covid-19 situation, it is possible that they will be sentenced to death.

 

"Are there any aggravating factors in the Covid-19 situation, of course the threat of punishment will be heavier. Even in such conditions, it could be the death penalty," the Attorney General said on Thursday, March 6, 2025.

 

The alleged corruption case of PT Pertamina's crude oil management occurred between 2018-2023 − at about the same period when the world, including Indonesia, was hit by the Covid-19 pandemic − with a state financial loss figure reaching Rp193.7 trillion (US$12 billion). During that period, Pertamina was required to seek supplies of petroleum from domestic contractors to fulfill crude oil needs before planning to import.

 

However, the suspects did not do that. Instead, they conspired to make domestic oil production not absorbed until the fulfillment of crude oil and refinery products had to be done by importing at a higher price. Meanwhile, domestic oil products were exported.

 

The Attorney General’s Office (AGO) is still investigating the case and will see how it develops before making a final decision. Nine people have been named as suspects, including officials at Pertamina’s commercial and tradinbg subholding PT Pertamina Patra Niaga, Pertamina’s refinery and petrochemical arm PT Kilang Pertamina Internasional, and several private companies.

 

The suspects are Riva Siahaan (RS), President Director of PT Pertamina Patra Niaga; Sani Dinar Saifuddin (SDS), Director of Feedstock and Product Optimization of PT Kilang Pertamina Internasional (KPI); Agus Purwono, Vice President (VP) of Feedstock Management of PT KPI; Yoki Firnandi (YF), an official at PT Pertamina International Shipping (PIS);  Maya Kusmaya (MK), Director of Central Marketing and Commerce of PT Pertamina Patra Niaga and Edward Corne (EC), VP Trading Operation of PT Pertamina Patra Niaga; Muhammad Kerry Adrianto Riza (MKAR), beneficial owner of PT Navigator Khatulistiwa; Dimas Werhaspati (DW), Commissioner of PT Navigator Khatulistiwa and Commissioner of PT Jenggala Maritim; and Gading Ramadhan Joedo (GRJ), Commissioner of PT Jenggala Maritim and President Director of PT Orbit Terminal Merak.
