House Commission chair: Criminal Code Procedure bill not to weaken KPK

Chairman of Commission III of the House of Representatives (DPR), Habiburokhman, has ensured that the Draft Criminal Code Procedure Code (RUU KUHAP) would not weaken the Corruption Eradication Commission (KPK). 

His comments were made in response to concerns raised by the KPK, which claimed that the bill could undermine the country’s anti-corruption efforts.

Habiburokhman, a lawmaker from the Gerindra Party, stressed that the House would consider input from all stakeholders, including the KPK. He said Commission III was open to meeting with KPK officials and anti-corruption activists to discuss the bill in greater detail.

“Of course, we do not want the RUU KUHAP to weaken corruption eradication,” he said at the DPR building in Senayan, Jakarta, on Wednesday, July 23, 2025.

He emphasized that the bill does not eliminate the lex specialis (special legal status) of the Anti-Corruption Law and the KPK Law, and instead could strengthen the KPK’s position. He pointed to Article 3(2) of the bill, which states that the Criminal Code Procedure applies to all criminal proceedings unless otherwise regulated by specific laws.

“This means the KPK can continue to operate under the Law on the Corruption Eradication Commission when handling corruption cases,” he said.

Habiburokhman also noted that Article 7(5) of the bill explicitly exempts KPK investigators from the supervision and coordination of the National Police, reaffirming the commission’s independence.

He assured the public that Commission III would not rush the bill’s passage and would thoroughly consider its implications.

Meanwhile, the KPK has formally requested an audience with President Prabowo Subianto and House Speaker Puan Maharani to discuss the draft law. The commission said it had not been informed of the latest developments in the legislative process.

“We submitted a request for an audience and our 17-point concerns regarding the RUU KUHAP to the President, with a copy sent to the Minister of Law,” Imam Akbar Wahyu Nuryamto, Head of Legislative Drafting at KPK’s Legal Bureau, said on Tuesday, July 22, 2025 at the KPK headquarters, as quoted by Antara.
