KLHK revokes Dairi’s permit in regards with Supreme Court’s ruling

The Ministry of Environment and Forestry (KLHK) has formally enacted the Supreme Court's ruling by revoking the environmental permit of PT Dairi Prima Mineral (PT DPM), a mining company operating in Dairi Regency, North Sumatra.

The revocation follows an appeal request filed by residents of Dairi Regency, who challenged the legality of PT DPM’s environmental permit. The company is engaged in the mining of zinc (Zn), lead (Pb), and silver in the region.

Rosa Vivien Ratnawati, Secretary of the Environment Ministry and Chief Secretary of the Environmental Control Agency (BPLH), announced that the ministry has issued Decree No. 888/2025, officially annulling the previous Ministerial Decree No. 854/MENLHK/SETJEN/PLA.4/8/2022.

“All activities and operations of PT DPM as outlined in the revoked decision are now without legal basis and must therefore cease,” Vivien said in a statement released on Monday, May 26, 2025.

She emphasized that environmental document evaluations will be further strengthened to ensure future decisions align with precautionary principles, environmental protection, and the broader public interest.

Vivien added that the Supreme Court's ruling serves as a critical legal precedent in Indonesia’s environmental governance and a reminder to all stakeholders that adherence to the law is essential for sustainable and responsible development.

The Supreme Court’s verdict No. 277 K/TUN-LH/2024 dated August 12, 2024, declared the 2022 ministerial decree null and void and mandated its revocation.

This ruling came after a lengthy legal battle initiated by a coalition of Dairi residents under the Legal Team of the Joint Secretariat Against Dairi Mining. Their lawsuit was first accepted by the Jakarta State Administrative Court on July 24, 2023.

However, the ruling was overturned at the appellate level, prompting the community to file a an appeal with the Supreme Court. The Supreme Court ultimately restored the original ruling, invalidating the environmental permit that served as the foundation for PT DPM’s operations.

This decision marks a major victory for environmental and community advocacy in Indonesia.
