KPU to officially declare Prabowo-Gibran as President-Vice President elect

The General Election Commission (KPU) will officially declare Prabowo Subianto-Gibran Rakabuming Raka as President-Vice President elect on Wednesday, April 24, 2024 after the Constitutional Court (MK) confirmed the pair’s 2024 election victory in a ruling on Monday.

The court ruled that KPU Regulation No. 360/2024 on the 2024 national election results was correct and legally valid and rejected the election lawsuit filed by the camps of Anies Baswedan-Muhaimin Iskandar and Ganjar Pranowo-Mahfud MD.

“The official declaration will be held on Wednesday, April 24, 2024, at 10:00 am the KPU office,” KPU chairman Hasyim Asy’ari after end of the MK hearing session on Monday, April 22, 2024.

Previously, the MK rejected the presidential election dispute filed by candidate pair number 1 Anies Baswedan-Muhaimin Iskandar and candidate pair number 3 Ganjar Pranowo-Mahfud MD. However, three of the eight justices gave dissenting opinions.

In addition to rejecting the applicant’s petition, the MK justices also rejected the objections filed by the respondents and related parties.

“We reject the applicant’s petition in its entirety,” Constitutional Court Chief Justice Suhartoyo said while reading the Court’s ruling on Monday.

The three justices who submitted dissenting opinions were Arief Hidayat, Saldi Isra, and Enny Nurbaningsih.

In presenting his dissenting opinion, Saldi believed that the MK should have ordered a re-vote in several regions. He argued that the petitioner’s arguments regarding the politicization of social assistance (bansos) and the mobilization of state apparatus were legally justified. In his considerations, Saldi mentioned several legal gaps in determining the decision according to the arguments presented by the petitioner.

Saldi pointed out the lack of clear legal rules on how a president should act in providing support in a presidential election. He cited the possibility of conflict between state and personal interests. However, according to him, there are no definitive rules for making such assessments.
