The Constitutional Court (MK) on Monday, April 22, 2024, rejected the 2024 presidential election dispute lawsuits filed by presidential-vice presidential candidates pair number 1, Anies Baswedan-Muhaimin Iskandar, and presidential-vice presidential candidates pair number 2, Ganjar Pranowo-Mahfud MD.
The hearings of the two lawsuits were held separately, with the hearing of the lawsuit by Anies-Muhaimin held in the morning, while the one by Ganjar-Mahfud in the afternoon.
“The Court rejects the applicant’s petition in its entirety,” Chief Justice Suhartoyo said while reading the Court’s ruling in the first hearing session of the lawsuit by Anies-Muhaimin camp as reported by Kompas.com.
Consideration of the ruling was read alternately by Suhartoyo and seven other Constitutional Court justices.
Opening the Court hearing on Monday morning, Justice Suhartoyo said that the Court’s ruling was made after a series of hearing sessions that had read the Anies-Muhaimin’s lawsuit as the applicant, heard the applicant’s statement, read and heard the response of the General Election Commission (KPU) as the respondent, read and heard testimony of the Prabowo Subianto-Gibran Rakabuming Raka camp as related parties and the Election Supervisory Agency (Bawaslu), as well as testimonies of witnesses and experts, and conclusions from Anies-Muhaimin camp, KPU, Prabowo-Gibran camp, and Bawaslu.
The Court had also read and heard the testimonies of Coordinating Minister for Human Development and Culture Muhadjir Effendy, Coordinating Minister for the Economy Airlangga Hartarto, Minister of Finance Sri Mulyani, and Minister of Social Affairs Tri Rismaharini. The Court also read amicus curiae statements from various parties and examined evidence provided by Anies-Muhaimin camp, KPU, Prabowo-Gibran camp, and Bawaslu.
In the afternoon, the same panel of eight justices also issued the ruling against the lawsuit filed by the Ganjar-Mahfud camp, similarly rejecting the applicant’s (Ganjar-Mahfud) petition in its entirety.
In their lawsuit to the Constitutional Court, Anies-Muhaimin and Ganjar-Mahfud camps both requested that Prabowo-Gibran be disqualified and an election revote be held. However, unlike Ganjar-Mahfud camp, the Anies-Muhaimin camp also included an alternative petition, namely seeking disqualification of Gibran from the 2024 presidential election while alleging that Gibran did not meet the administrative requirements on minimum age limitation to contest the election.
Both Anies-Muhaimin and Ganjar-Pranowo camps also accused of structured, systematic and massive (TSM) violations, as well as violations of election principles as stipulated in the 1945 Constitution in relation to alleged nepotism on Gibran’s candidacy and the deployment of State resources to help boost Prabowo-Gibran’s votes.
None of the additional petitions were granted by the Constitutional Court.
Based on KPU Decree No. 360/2024 on Results of the 2024 Presidential Election, Ganjar-Mahfud collected 27,040,878 votes or around 16.47 percent of all national valid votes. The pair was far behind Prabowo-Gibran, who garnered 96,214,691 votes or around 58.58 percent of all national valid votes. Meanwhile, Anies-Muhaimin bagged 40,971,906 votes or around 24.95 percent of all national valid votes.
