Agung Sedayu defends legality of National Strategic Project PIK 2

A lawyer for PT Agung Sedayu Group, a parent company of PT Pantai Indah Kapuk Dua (PIK 2), has defended the legality of the national strategic project (PSN) PIK 2 and clarified its involvement in the erection of the 30-kilometer sea fence off Tangerang waters, Banten province.

The lawyer, Muannas Alaidid, said that all land use certificates (SHGB) owned by PIK 2 had been issued in accordance with applicable procedures.

“The SHGB was issued through a legal process, starting from purchasing from the community, paying taxes, to processing location permits (SK Lokasi/PKKPR),” Muannas said as quoted in a statement made available to the media on Thursday, January 23, 2025.

He dismissed the allegations that the entire 30-kilometer sea fence erected off Tangerang waters, Banten province belongs to PIK 2, but only a part of it.

“There are a total of 234 plots with SHGB status in the name of PT Intan Agung Makmur, 20 SHGB plots belonging to PT Cahaya Inti Sentosa, and nine plots in the name of individuals. In addition, there are 17 plots with land ownership certificate (SHM) status in the area. Not all SHGB plots along the 30-km sea fence belong to PIK 2,” Muannas said.

He emphasized that SHGB ownership related to Agung Sedayu Group, a company owned by tycoon Sugianto Kusuma or Aguan, and its subsidiaries are in Kohod Village, Pakuhaji District, Tangerang Regency.

The erection of the 30-km sea fence is controversial due to alleged misappropriation of the plots, along with the recent findings of luxury cars worth billions of rupiah, belonging to a village head within the Tangerang regency. The vehicles are deemed too costly for a village head in common, with a civil servant status, to acquire.

President Director of Agung Sedayu Group, Nono Sampono, had earlier emphasized that the PSN PIK 2 project was carried out legally and aimed to secure state assets.

“This is a halal item. It [the project] belongs to the state. As the state has many things to do, it is being carried out by the private sector,” Nono said in a statement as quoted from the Agung Sedayu Group YouTube channel posted on December 18, 2024.

He said further that a strong legal basis is the main requirement in implementing a project of this magnitude.

“Without legal basis, this project is not halal. This project has secured support through the Presidential Decree, the Decree of Minister of Tourism and Creative Economy, and an agreement between related ministries, such as the Coordinating Ministry for the Economy and the Ministry of Tourism and Creative Economy,” he cited.

Previously, Minister of Agrarian Affairs and Spatial Planning (ATR) Nusron Wahid revealed that there were 263 plots of land in the form of SHGB, 234 plots of which are owned by PT Intan Agung Makmur and 20 plots in the name of PT Cahaya Inti Sentosa, and nine plots of land in the name of individuals. In addition, there are 17 SHM plots.

Data at the Directorate General of General Legal Administration (Ditjen AHU), the Ministry of Law, reveals that PT Cahaya Inti Sentosa is a company operating in the real estate sector.

The company was established on December 14, 2023 with the Approval Decree No. AHU-0078522.AH.01.02.Year 2023. The location of this company is in Area 100 Block C Number 6, Jalan Kampung Melayu Timur, Teluknaga, Tangerang, Banten.

The company, which was founded with a capital of Rp89.1 billion, is owned by PT Agung Sedayu, PT Tunas Mekar, and Pantai Indah Kapuk 2, and a number of people.

Legal document reveals that Nono Sampono is President Director of PT Cahaya Inti Sentosa, Kho Cing Siong as President Commissioner, and Belly Djaliel as Director. In addition, there is also Freddy Numberi as Commissioner, Surya Pranowo Budihadjo as Director, and Yohanes Edmond Budiman also as Director.

Nono Sampono, a retired three-star Marine general, was Deputy Speaker of the Regional Representatives Council (DPD) for the 2019-2024 period, and once ran for Maluku Governorship and Deputy Jakarta Governorship.
